The appeal is allowed and outline planning permission has been refused for the development of up to 137 dwellings, public open space, access and associated works in accordance with application ref: 12/02352/OUT, dated 18 May 2012. These reports also considered two other appeals in Tattenhall. 1 On11 December 2012 the appeal was recovered for the Secretary of State’s determination, in pursuance of section 79 of, and paragraph 3 of Schedule 6 to, the Town and Country Planning Act 1990, because it involved a proposal for residential development on a site over 5 ha, which would significantly impact on the Government’s objective to secure abetter balance between housing demand and supply and create high quality, sustainable mixed and inclusive communities.
