Section 106

Planning obligations under Section 106 of the Town and Country Planning Act 1990 (as amended), commonly known as a Section 106 agreements, are a mechanism which makes a development proposal acceptable in planning terms and are focused on site specific mitigation of the impact of development.

The Section 106 agreement will detail affordable housing provisions, education contributions, health and local highways improvements as necessary and the Richborough team negotiates the details and financial contributions with the District and County Councils.

In terms of developer contributions, the Community Infrastructure Levy has not replaced Section 106 agreements. CIL has been introduced to address the broader impacts of development.
