The development proposed of the demolition of existing car workshop and erection of 10 residential dwellings has been dismissed.

The main issues in this case are i) scale of development proposed and parking provision, and ii) developer contributions.

The development proposed of the creation of a retirement village that will provide 200 No.one and 2 bed assisted living residential dwellings has been dismissed.

The main issue is whether the appeal site represents an appropriate location for housing having regard to national and local policies which seek to protect the character and appearance of the countryside, including the setting of GradeII Listed structures Westfield Farm House and a Medieval Cross Base, and whether any adverse impacts would significantly outweigh the benefits of the proposal.

The development proposed is described as an outline planning application for the development of up to 150 dwellings (Use Class C3), provision of land for community allotments, associated strategic landscaping, open space, and associated highways,drainage and other infrastructure works, with all matters reserved for subsequent approval apart from the primary means of access, on land to the south of Wicken Road,Newport. – this has been dismissed. 

The appeal is allowed and outline planning permission is granted for residential development of up to 125 dwellings, with public open space, landscaping and associated infrastructure at Land off Meadow Park, Willand, Devon (NGR303288 110467) in accordance with the terms of the application, Ref18/00175/MOUT, dated 24 January 2018, subject to the conditions set out in the attached schedule.

The appeal is allowed and planning permission is granted for demolition of an existing dwelling and outbuildings to allow for a residential development comprising up to 66no. dwellings with associated parking, access, internal roads, public open space, landscaping, drainage and other associated infrastructure at land at and to the rear of 42 Worminghall Road, Ickford HP189JD, in accordance with the terms of the application, Ref 17/03322/AOP, dated 25 August 2017, subject to the conditions set out in the Schedule of Conditions at the end of this decision.

The development proposed of mixed use development comprising of housing (including affordable housing and sheltered accommodation), employment, public open space,local community parkland and landscaping has been dismissed.

The main issue is whether the proposal complies with the development plan taken as a whole, and if not, whether there are material considerations to justify a decision otherwise than in accordance with the development plan.

The development proposed of a residential development of 11 dwelling houses has been dismissed.

The main issues are:
• whether or not the appeal site is a suitable location for residential development, with particular regard to local and national planning policy for the delivery of housing;
• the effect of the proposal on the character and appearance of the countryside; and
• the effect of the development on the setting of nearby listed buildings. 

The development proposed of the erection of up to 140 Dwellings, with public open space, landscaping, sustainable drainage system, and vehicular access has been dismissed.

Having regard to all the submissions before me, I consider the main issues in the appeal to be as follows:
▪ whether the district has an adequate supply of deliverable land for housing;
▪ the effects of the proposed development on the highway network and safety;
▪ the effects on the character and appearance of the area and its landscape;
▪ the effects on the setting of nearby listed buildings;
▪ the effects on ‘best and most versatile’ agricultural land;
▪ and whether the appeal site is a suitable location for the proposed development, having regard for the CDLP’s policies for the location of housing.

The development proposed of demolition of the existing clubhouse and structures on the site, and the erection of a new clubhouse (Use Class D2), improvements to the existing football pitches, a new under 7/8s football pitch and the erection of 21 residential dwellings (Use Class C3), together with associated car parking, landscaping and infrastructure works has been dismissed.

These are:
i.the effect of the proposal in the context of development plan policy for protecting Metropolitan Open Land (MOL) from inappropriate development and preserving its openness;
ii.the effect on the surrounding landscape as defined an Area of Special Character (ASC) and part of the South East London Green Chain (SELGC);
iii.whether the proposal would preserve or enhance the character or appearance of the Eltham Palace Conservation Area (EPCA)
iv.whether the harm to MOL, and any other harm, would be clearly outweighed by other considerations. If so, would this amount to the very special circumstances required to justify the proposal.

The appeal is allowed, and outline planning permission is granted for the erection of up to 84 dwellings with public open space, landscaping and sustainable drainage system (SuDS) and vehicular access point from Merton Road. All matters reserved except for means of access, at land at Merton Road, Ambrosden, OX25 2NP in accordance with the terms of the application Ref. 18/02056/OUT, dated 26 November 2018, subject to the conditions in the schedule at the end of this decision.
