The development proposed described as ‘mix of 36no new dwellings ranging from 1-bed, 2-person, up to 5-bed, 7-person houses with a mix of tenure. Affordable housingwill be provided as part of the dwelling mix in line with local requirements has been dismissed.

The main issues in this appeal are:
•Whether the appeal site is a suitable location for the appeal scheme with reference to policies concerned with housing in rural areas;
•The effect on the character and appearance of the area;
•Whether the proposal would make adequate provision for affordable housing and the long-term maintenance of the sustainable drainage system; and
•Whether the application of Paragraph 11 of the National Planning Policy Framework indicates a decision should be taken other than in accordance with the development plan.

The appeal is allowed, and the reserved matters are approved, namely appearance, landscaping, layout and scale submitted in pursuance of Condition 1 attached to planning permission Ref 17/00579/OUT dated 19 October 2017,and subject to the conditions set out in the attached schedule. In addition, the details submitted pursuant to Conditions 4, 7, 10, 11, and 23 attached to planning permission Ref 17/00579/OUT dated 19 October 2017, in accordance with application Ref 18/01082/REM dated 22 June 2018, are approved.

The development proposed of remediation of the entire landholding and the creation of a community forest with an area 21.23 ha, with enabling residential development of 16 detached dwellings, associated landscaping, access and parking has been dismissed.

The development proposed of the erection of 14 no. two-storey residential dwellings and 3 no. bungalows (Use Class C3) and creation of new areas of public open space, with access off Ickford Road, including parking and garaging, landscaping and all enabling and ancillary works has been dismissed. 

The main issues are:

•The effect on the character and appearance of the area, including landscape character and visual impact; and
•Access to facilities and services.

The development proposed of residential development of up to 265 dwellings and associated infrastructure has been dismissed.

the main issue in this appeal to be the effect of the proposal on the character and appearance of the area.

The development proposed of the erection of 13 dwellings, central open space area(including SUDs) and access onto Hartwell Road has been dismissed.

The main issues are:
•whether the appeal site is an appropriate location for development of thistype, having regard to access to local services and facilities and developmentplan policies,
•the effect of the development on the character and appearance of the area,and
•whether the Council can demonstrate a National Planning Policy Framework(the Framework) compliant supply of deliverable housing sites. 

The development proposed of up to 58 Dwellings (including up to 23 Affordable Homes) with access to be determined, including associated garages, car parking,infrastructure, open space and landscaping and potential dedication of land for community use has been dismissed.

The main issues are:
• whether the site would provide an appropriate location for the development, having regard to local and national planning policies relating to the location for new development;
• the effect of the development on local infrastructure, including the local highway network and services and community facilities in Medstead and Four Marks;
• the effect of the development on the character and appearance of the area; and
• whether the development would make adequate provision for affordable housing. 

The appeal is dismissed and planning permission for residential development of up to 26 dwellings is refused

The main issue is whether the site is a suitable location for the proposal, having regard to the development plan, its implications for the character and appearance of the area and the HHCA, and the setting of Listed Buildings.

The proposed development of the new residential development and associated new roads, infrastructure and open space has been dismissed.

The main issues are:
– whether the site would be an appropriate location for residential
development having regard to the development plan and national planning
policies and the character and appearance of the area;
– the effect of the proposed development on the setting of the Grade II listed
Ladymeade.
– the effect of the proposed development on highway and pedestrian safety in
the vicinity of the site; and
– whether the proposed development would exacerbate the existing flooding
and pollution problem in the village during periods of heavy rainfall.

The proposed development described as ’36 dwellings (including 11 affordable units) has been dismissed.

The second of the two reasons for refusal of planning permission concerns the ability of the proposal to adequately deal with surface water drainage. With the Appellant’s statement, a further flood risk assessment and surface water drainage strategy was submitted 1, and in the statement of common ground (para 5.2.8) it is agreed that surface water drainage could be addressed by means of a condition. Accordingly, I consider that the single main issue in this appeal is the effect of the proposed development on the supply of homes.
