The appeal is allowed. The planning obligation, dated 3 May 2011, made between Test Valley Borough Council and Wates Developments Limited and others shall have effect subject to the following modifications:
a)Operative Provisions; Section 2 Interpretation – Delete the definition of‘Junior Sports Pitch Land’ in its entirety.
b)Schedule 1 Part 2 – Delete paragraphs 48, 49 & 50 in their entirety.

Scaffold Hill Farm, Whitley Road, Benton, Newcastle upon Tyne
The appeal is allowed and planning permission is granted for up to 38 dwellings incorporating the under grounding of overhead power cables andre-provision of allotments at Scaffold Hill Farm, Whitley Road, Benton,Newcastle upon Tyne in accordance with the terms of the application,Ref 18/00081/OUT, dated 17 January 2018, subject to the conditions set out in the Schedule to this Decision.
122 Bromham Road, Bedford
The proposed development of the erection of a building to provide 14 additional flats along with new access has been dismissed.
The main issues are:
– the effect of the proposal on the character and appearance of the area including the Bedford Conservation Area and the setting of nearby listed buildings,
– the effect on the living conditions of adjoining occupiers with particular regard to outlook,
– whether adequate provision would be made for the sustainable disposal of surface water, and
– the effect of the proposal on trees.
Land Southwest of Middleton Road, Winterslow, Wiltshire
The development proposed is described as ‘Outline application to erect up to 22 market dwellings, 9 affordable dwellings, and 4 elderly bungalows; provide a new access from Middleton Road and pedestrian footpath alongside Middleton Road; provide circa 4,500 m2 of public open space including ‘LAP’children’s play area, ecological buffer to Brown’s Copse, and drainage detention basin(re submission of application 17/02002/OUT) has been dismissed.
Beaufort Park, South Road, Bracknell, Berkshire
The appeal is allowed and outline planning permission is granted for the demolition of an existing vacant office building (Beaufort Park) and the redevelopment of the site for up to 68 dwellings, plus associated parking,landscaping, highway improvements and ancillary works at Beaufort Park,South Road, Bracknell, Berkshire RG40 3DN in accordance with the terms of the application, Ref 17/01123/OUT, dated 23 October 2017, subject to the conditions contained in the attached Schedule of Conditions.
Land to the east of Furze Court, Wickham Road, Fareham
The proposed development of the construction of 12 dwellings together with associated access, car parking, drainage and landscaping has been dismissed.
The main issues are:
• The effect of the development on Solent Coastal Special Protection Areas;
• The effect of the proposed development on the supply of open space in the area;
• Whether or not the proposed development would make adequate provision for affordable housing; and
• The effect of the proposed dwellings on the character and appearance of the countryside.
Land at Holme Farm, Toft Hill, Bishop Auckland
The proposed development of the residential development (up to a maximum of 22 dwellings), including access, with all other matters reserved has been dismissed.
The main issues are the effect of the proposals on:
• the highway with respect to safety and the living conditions of neighbouring occupiers, and
• the character and appearance of the area.
