The proposed development of outline development of residential dwelling units and associated works to include details of access has been dismissed. 

The main issue is the effect of the proposal on the character and appearance of the surrounding area, including the setting of the Peak District National Park.

The appeal is allowed and planning permission is granted for demolition of the existing garden centre buildings and redevelopment of the site to provide a total of 110 care apartments and bungalows together with associated car parking, landscaping and amenity spaces at Beechmoor Garden Centre,Whitchurch Road, Great Boughton, Chester CH3 5QD in accordance with the terms of the application, Ref 17/03661/FUL, dated 21 August 2017, subject to the conditions in the attached schedule

The proposed development described as a detailed planning application for the erection of 75 two storey 2, 3 & 4 bedroom semi and detached dwellings with associated works has been dismissed. 

The main issue is whether or not the proposed development would give rise to an unacceptable impact on the public highway with particular regard to delays through queuing and the free flow of traffic

The proposed development of the erection of up to 270 dwellings with public open space/community park, landscaping and sustainable drainage system and vehicular access point from Melton Road, with all matters reserved except for means of access has been dismissed. 

In the light of the reasons for refusal of the application and the matters subsequently agreed, I consider that the main issue in the appeal is whether the proposal would provide a sustainable form of development in accordance with national and local policy, having particular regard to the settlement strategy of the development plan. 

The proposed development of residential development for up to 30 units has been dismissed.

The main issues are:
•The effect of the proposal on the character and appearance of the area; and
•Whether the site would be a suitable location for new housing, having regard to social and physical infrastructure in the locality.

The proposed development of five apartments in a single block, incorporating three floors over a semi-basement parking level has been dismissed.

2. (i) Whether the proposal would be inappropriate development in the Green Belt having regard to the revised National Planning Policy Framework (the Framework) and any relevant development plan policies.
3. (ii) The effect on the openness of the Green Belt.
4. (iii) The effect of the proposal on biodiversity.
5. (iv) Whether the proposed development would preserve or enhance the character or appearance of the Bramcote Conservation Area and preserve the setting of listed buildings.
6. (v) The effect of the proposal on the character and appearance of the locally designated landscape.
7. (vi) If the proposal is inappropriate development, whether the harm by reason of inappropriateness, and any other harm, is clearly outweighed by other considerations so as to amount to the very special circumstances necessary to justify the development.

The appeal is allowed and planning permission is granted for the erection of 71 dwellings with associated garages, garden curtilages, a Sustainable Urban Drainage system (SUDS), public open space, hard and soft landscaping at Land off Mount Hill, Halstead, Essex in accordance with the terms of the application,Ref 18/00774/OUT, dated 27 April 2018, subject to the conditions contained in the schedule at the end of this decision. 

The proposed development of outline application for residential development of up to 30 dwellings, public open space and ancillary works, will all matters reserved has been dismissed.

The main issues in this appeal are:
•the effect of the proposed development on the character and appearance of the area;
•whether there is a local need for the housing to justify development of the land as a Rural Exception Site;
•whether the proposed affordable housing and adequate provision for infrastructure have been satisfactorily secured through an appropriate Planning Obligation (PO).

Appeal A – The development proposed is 18 dwellings including affordable housing, 36 retirement living/sheltered accommodation units, 60 bed care home, vehicular and pedestrian access from Colchester Road, public open space and structural landscaping has been dismissed.

Appeal B – The development proposed is 26 dwellings 30% affordable housing, vehicular and pedestrian access from Armoury Road and Coopers Crescent, public open space and structural landscaping, has been dismissed.

Main issues in this case, the effect of the proposed development upon the character and appearance of the area. Whether the proposal makes adequate provision for any addition al need for affordable housing, open space, sport and recreation, community facilities, primary education. Also whether the council is bale to identify a five-year supply of deliverable housing sites against the housing requirement. 

The proposed development is up to 42 dwellings which has been dismissed. 

The main issues are:
•The effect of the development on the character and appearance of the area with specific regard to the landscape and visual impacts; and
•Whether the council can demonstrate a five year supply of housing land.
