For the following reasons the appeal is allowed and planning permission is granted for the erection of up to 25 dwellings, provision of open space and land for a new burial ground on land at Crabtree Farm, Hinckley Road, Barwell, Leicsin accordance with the terms of the application, No 18/00279/OUT, dated 15 March 2018, subject to the conditions set out in the attached schedule.
Tuscany and land rear of Tuscany, Chavey Down Road, Winkfield Row, Bracknell
The development proposed was described on the application form as “demolition of single dwelling and erection of 12 dwellings with associated access road and landscaping has been dismissed.
The main issues are the effect of the proposed development on:
(a)the character and appearance of the area;
(b)flood risk and the provision of drainage;
(c)highway safety; and
(d)the Thames Basin Heaths Special Protection Area (SPA).
Old Reservoir Farm, East Street, Billingshurst
The proposed development described on the application form as ‘redevelopment to provide up to 10 no dwellings and access’ has been dismissed.
the main issues are (i) the effect of the development proposed on landscape character, (ii) whether or not it has been demonstrated that access arrangements would be safe and suitable, and (iii) whether or not appropriate provision is made for affordable housing. In the event that I find that harm would result, I will then gauge whether any material considerations in favour of the proposal would nonetheless justify allowing the appeal.
OS Field 1900, Stillington Road, Huby
The development proposed is described as a ‘change of use from agricultural land to residential use for construction of 10 detached dwellings with associated access, parking and gardens has been dismissed.
There are three main issues. These are a) the effect of the proposed development on the character and appearance of the area; b) whether the proposed development would make appropriate provision for affordable housing; and c) whether the appeal site would be an appropriate location for new housing having regard to the development plan and sustainable patterns of new development.
Bury Spinney, Thorn Road, Houghton Regis
The development proposed is described as ‘Residential development for up to 100 dwellings with all other matters except access reserved. The proposed development is within the designated HRN2 site earmarked for development as part of the northern expansion of Houghton Regis has been dismissed.
Given the above, the main issues are:
• The effect on the openness of the Green Belt.
• Highway safety.
• Whether the proposal makes adequate provision for the infrastructure
needed to support the development.
• Whether the harm, by reason of inappropriateness, and any other harm,
is clearly outweighed by other considerations. If so, would this amount
to the very special circumstances necessary to justify the proposal.
Land off Ellesmere Road, Shrewsbury
The appeal is allowed and planning permission is granted for residential development and formation of vehicular access at Land off Ellesmere Road,Shrewsbury SY1 2QR in accordance with the terms of the application,Ref 18/02392/OUT, dated 23 May 2018, subject to the conditions set out in the attached schedule.
Fied 7245, North/North-East of St Cuthbert’s Crescent
The proposed development is described as residential development of up to 50 dwelling houses with all matters, except access, reserved has been dismissed.
The main issues are the effect of the proposed development on the character and appearance of the surrounding area and the Trimdon Conservation Area.
Land adjacent to Withen Cottage and Cheshire Lane, Alltami Road, Buckley, Flintshire
The appeal is allowed and planning permission is granted for the erection of 14 dwellings and associated works at land adjacent to Withen Cottage and Cheshire Lane, Alltami Road, Buckley, Flintshire in accordance with the terms of the application, Ref 058229, dated 13 March 2018, and the plans submitted with it, subject to the conditions set out in the Annex below.
Land to the rear of the former Dylon International Premises
The appeal is allowed and planning permission is granted for the demolition of existing buildings and the redevelopment of the site by the erection of a 4 to 8-storey development comprising 151 residential units (63, one-bedroom;80, 2-bedroom & 8, 3-bedroom) together with the construction of an estate road, ancillary car and cycle parking and the landscaping of the east part of the site to form open space accessible to the public on land to the rear of the former Dylon International Premises, Station Approach, Lower Sydenham,London SE26 5BQ in accordance with the terms of the application,Ref DC/18/01319/FULL1, dated 19 March 2018, subject to the conditions attached at Annex 4
Land off Hepworth Road, Woodville DE11 7DW
Appeal A – The development proposed is self and custom build residential development consisting of 30 plots with a new access and supporting infrastructure (outline – access and layout included) at Land Off Hepworth Road, Woodville, Swadlincote has been approved
Appeal B – The development to which the planning obligation relates is Part Three of the Schedule to the 2004 Section 106 Agreement (dated 3 June 2004) relating to application 02/01416/OUT has been allowed also.
