The application sought planning permission for residential development of up to 44 dwellings including specific accommodation for over 55s and open space, with all matters reserved except for access without complying with a condition attached to planning permission Ref CB/16/04369/OUT, dated 13 April 2017 has been dismissed. 

The main issue is whether the condition is necessary to make the development
acceptable with regard to meeting local housing needs for older people, and if so,
the effect that varying the condition would have on meeting that local need.

The appeal is allowed and planning permission is granted for erection of up to 30 no. dwellings served via new access from Clifford Smith Drive, complete with related infrastructure, open space and landscaping at Land East and North of Clifford Smith Drive, Watch House Green, Felsted CM6 3UG in accordance with the terms of the application, Ref UTT/18/0784/OP, dated 21 March 2018,subject to the attached Schedule of Conditions.

The appeal is allowed and outline planning permission with all detailed matters reserved except access is granted for the erection of up to 110 dwellings with public open space, landscaping and sustainable drainage system (SuDS) and vehicular access point from Henthorn Road at Henthorn Road, Clitheroe BB7 2QF in accordance with the terms of application Ref 3/2018/0688, dated 7 August 2018, subject to the attached schedule of conditions.

The proposed development described as ‘outline planning consent with all matters except of access (i.e. appearance, layout, scale and landscaping) reserved, for residential development comprising up to 225 dwellings, a new link road between Ball Roundabout and B3314, new highway access, provision of a new pedestrian/cycle bridge over A39, new primary school, new local centre, employment area, family pub,public open space, landscaping and associated infrastructure has been dismissed.

The application Ref.PA18/05209, dated 25 May 2018, was refused by notice dated 31 January 2019.

The proposed development described as a ‘development of 14no dwellings with associated access, parking and gardens, and ecological habitat has been dismissed. 

The main issues are;
i.the effect of the proposal on the character and appearance of the area;

ii. whether the scheme would provide adequate living conditions for future residents in respect of privacy, noise and amenity space; and for existing residents in terms of privacy;

iii.the adequacy of the highway access arrangements; and

iv.the adequacy of the planning obligation to mitigate the effects of the development.

The proposed development of residential development of up to 25 dwellings has been dismissed. 

The main issues are;

The effect of the development on the character and appearance of the landscape, with particular reference to the location of the site relative to Colchester and Eight Ash Green.
•Whether the development would provide acceptable living conditions for future occupants, with particular regard to air quality and the effect of the development on the Lucy Lane Air Quality Management Area (AQMA).
•The effect of any necessary noise mitigation/attenuation measures required to provide acceptable living conditions for future residents on the layout and design of the development.

The proposed development was originally described as ‘demolition of existing dwelling and erection of 24no new houses and associated external works has been dismissed.

The main issues are (a) the effect of the proposed development on the character and appearance of the area and (b) whether the proposed development would provide acceptable access to services and facilities.

The appeal is allowed. The section 73 application is granted to amend Condition 12 (approved plans), on planning application reference 2008/0287, (to demolish offices, car parking and storage areas and erection of 44 dwellings with associated roads and sewers), at Sol Homes Limited, Vale Road, Colwick, Nottingham, Nottinghamshire NG4 2EG, in accordance with; the terms of the application 2016/0347 dated 25 February 2016; a Unilateral Undertaking for an education contribution of £75,000; and subject to the attached condition schedule.

The proposed development of the demolition of existing dwelling and residential development of up to 122 dwellings with associated parking, garaging and landscaping.Formation of new access road. Creation of public open space and landscape and biodiversity enhancements to Stone horse Lane has been dismissed.

The main issues are:
• the effect on the openness of the Green Belt and whether the proposal would conflict with the purposes of the Green Belt;
• the effect of the proposal on the character and appearance of the area with particular regard to its location within the Dillywood Lane Area of Local Landscape Importance;
• The effect of the proposal on best and most versatile agricultural land; and,
• whether the harm by reason of inappropriateness, and any other harm, is clearly outweighed by other considerations so as to amount to the very special circumstances necessary to justify the development.

The appeal is allowed and outline planning permission is granted for proposed development of 175 dwellings including vehicular access, pedestrian links,public open space, car parking, landscaping and drainage (all matters reserved)at Land at Asher Lane, Ruddington, in accordance with the terms of the application Ref 18/00300/OUT, dated 1 February 2018, subject to the conditions set out in the attached schedule.
