The development proposed is residential development and means of access for up to 39 houses on land off Avon Dassett Road, Fenny Compton has been dismissed.

The main issues are:

•whether the proposal is in accordance with the development strategy set out in the development plan;
•the effect on heritage assets, namely the setting of the Fenny Compton Conservation Area (the FCCA), the setting of Rectory Farmhouse, a GradeII listed building, the setting of Gredent on Hill Camp, a Scheduled Monument (SAM), and the medieval ridge and furrow field form;
•the effect on the character and appearance of the area;

•whether the proposal makes adequate provision for affordable housing,

infrastructure and associated facilities

The development proposed is the erection of up to 20 residential dwellings with all matters reserved other than access has been dismissed. 

The main issues are:
•The effect of the development on the character and appearance of the area, the landscape character and visual impact;
•The effect of the development on biodiversity; and
•Whether the proposed development would, if necessary, provide suitable contributions towards local infrastructure.

The development proposed is the demolition and removal of existing buildings,structures and hardstandings to facilitate the erection of up to 17 no. dwellings and associated infrastructure, including the location of the access to the public highway (Hinwick Road) has been dismissed.

The main issues are:
• whether or not the appeal site is a suitable location for residential development, with particular regard to the Council’s settlement strategy and national planning policy objectives for rural housing and sustainable transport; and
• the effect of the proposal on the character and appearance of the area.

The development proposed is the erection of up to 66 dwellings with associated landscaping, open space and vehicular and pedestrian access has been dismissed.

With the context to the appeal as set out above I identify here the main issues
to be determined. They are:
(a) Whether the Council can demonstrate a deliverable 5 year supply of
housing land;
(b) Whether the site is an acceptable location for the proposed
development;
(c) The impact of the proposed development on the character and
appearance of the village and its surroundings;
(d) The impact of the proposed development on heritage assets;
(e) In light of my findings on the above, and any other matters, the
planning balance to be struck.

The proposed development is described as the erection of 18 dwellings with all matters reserved bar access has been dismissed. 

The main issues are:
•The effect of the development on the character and appearance of the area;
•Whether the appeal site is an appropriate location for the development having regard to the development plan, and;
•Whether the development has prospect of being delivered within the next five years

The proposed development is described as erection of 20 new dwellings with garages and internal access road on land adjacent to the settlement boundary of eye has been dismissed.

The main issues in this appeal are the effect of the proposal on:
•The character of the area and the landscape setting of the site;
•Ecology and biodiversity, including protected and priority species habitats;
•Highway safety and whether a safe and suitable access to the site could be achieved; and
•Whether the proposal would make adequate provision for any additional need for affordable housing, and foul and surface water drainage, arising from the development.

The development proposed is described as: ‘Outline application for 10 2 bed bungalows.New access road to site. Demolition of No 6 Scawfell Crescent. Demolition of buildings on site. App. 4/18/2266/001 has been dismissed. 

From all that I have read, I consider the main issues in this case to be the effect of the proposed development on:
•the character and appearance of Scawfell Crescent with regard to open space;
•the living conditions of nearby residents with regard to noise and disturbance, and open space;
•whether a satisfactory access to the site can be provided, having regard to the safety of all users, including vehicles and pedestrians;

The proposed development is described as ‘outline application for up to 50 dwellings. All matters reserved except access’ has been dismissed. 

Accordingly, the main issues for the appeal are:
• Whether the proposed housing would be in an acceptable location having regard to development plan and national policies, and
• The effect of the proposed development on the character and appearance of the surrounding area and on the Grade I listed Church of St Nicholas.

The appeal is allowed and planning permission is granted for a hybrid application to include full planning for 194 dwellings (houses and bungalows)and an outline application to erect 5 detached dwellings with associated works including foul pumping station, landscaping, public open space, parking areas and garaging at land at Brigsley Road, Waltham in accordance with the terms of the application, Ref DM/1167/16/FUL, dated 14 December 2016, subject to the conditions in the attached schedule.

The development proposed is the demolition of existing agricultural shed buildings,residential development of up to 370 dwellings (Use Class C3); a flexible use building (floor space circa 460 sq. m.) falling within Use Class D1; public open space; accesses onto Gloucester Road and associated infrastructure has been dismissed.

The main issue is whether the lpa can show a 5-year supply of land for housing; the effect on heritage assets (HA); the effect on the character and appearance of the area; the acceptability of the proposed pedestrian links to local services/facilities; and whether the proposal would be premature to and predetermine provisions central to the emerging JSP.
