The proposed development is residential development of up to 10 dwellings has been dismissed. 

The main issues are:
•the effect of the proposal on the character and appearance of the countryside; and
•whether or not the appeal site is a suitable location for residential development having regard to local and national planning policy for the delivery of housing.

The appeal is allowed and planning permission is granted for residential development up to 16 dwellings at Land at Chapel Lane, Marton Le Moor HG4 5AT in accordance with the terms of the application, Ref 17/04295/OUTMAJ, dated 26 September 2017, subject to the conditions in the attached Schedule.

The proposed development is an outline application for up to 95 residential dwellings, with as sociated landscaping, drainage and open space on the land north of Estover Road. 

The main issue is the effect of the development on the character and appearance of the area.

The development proposed is the demolition of the existing golf club house and commercial premises of KM Elite Products Ltd, and the construction of 10 dwellings,together with vehicular access, replacement clubhouse, access and car park has been dismissed.

The main issues therefore are (a) whether the appeal site would be suitable for housing having regard to its location and the effect of the development on the character and appearance of the countryside and (b) the impact of the proposal on availability of employment land.

The proposed development of the construction of up to 50 dwellings, of which 40% would be affordable, with the means of vehicular access from Charlbury Road, landscaping, earthworks to facilitate surface water drainage and all other ancillary infrastructure and enabling works has been dismissed. 

At the inquiry the LPA agreed that the proposed development would not adversely affect the setting of Leafield Parish Church, and the unilateral undertaking includes planning obligations to secure affordable housing and to make financial contributions towards various forms of infrastructure. Accordingly, I consider that the main issues in this appeal are:
(i) The effect of the proposed development on the setting of Hailey Conservation Area.
(ii) The effect of the proposed development on the character and appearance of the area.
(iii) Whether the site is a sustainable location for the development proposed.
(iv) Whether the proposal would be consistent with the Development Plan.
(v) The effect of other considerations on the overall planning balance

The appeal is allowed and planning permission is granted for demolition of the existing basement and concrete plinth above and erection of a building of between 1 and 7 storeys containing 217 residential apartments (Use Class C3),including a café (Use Class A3) measuring 146 sqm (GIA), car and cycle parking, plant enclosures, access improvements, service bay, drop off spaces,substation, and associated landscaping and open space; and a five storey building to provide 16,389 sqm (GIA) of office floor space (Use Class B1),together with ground level and basement car and cycle parking, service bay and associated landscaping at 67 Alma Road, Windsor in accordance with the terms of the application, ref. 18/00095/FULL, dated 11 January 2018, subject to the conditions set out in the attached schedule

The appeal is allowed and outline planning permission is granted for up to 200 dwellings (Use Class C3) together with an access roundabout on Stafford Road,public open space, landscaping and associated infrastructure at land off Stafford Road, Penkridge in accordance with the terms of the application, Ref 17/01022/OUT, dated 10 November 2017 subject to the conditions set out in the schedule to this decision notice.

The proposed development is the residential development of sixteen units comprising 11 market housing units and 5 local need affordable housing unit has been dismissed.

The main issues are:
• Whether the proposal constitutes inappropriate development in the Green Belt having regard to the Framework and any relevant development plan policies.
• The effect of the development on the openness of the Green Belt and the purpose of including land within it.
• The effect of the proposal on the character and appearance of the area.
• The effect of the proposal on green infrastructure.
• The effect of the proposal on public rights of way and access.
• If the development does constitute inappropriate development in the Green Belt, whether the harm by reason of inappropriateness is clearly outweighed by other considerations, so as to amount to the very special circumstances necessary to justify the development.

The proposed development for up to 42 dwellings with all matters reserved except for means of access has been dismissed.

The main issue is the effect of the proposal on the character and appearance of the area.

The application Ref 17/01004/REM, dated 12 December 2017, sought approval of details pursuant to condition No 1 of a planning permission Ref 13/00990/OUT, granted on 10 April 2015

The proposed development is described on the planning appeal form as “Outline application with some matters reserved (appearance, landscaping, layout and scale) for 28no. dwellings, associated means of access and demolition of 61 Harlsey Road and 61A Harlsey Road has been dismissed.

The main issues were whether the site would be suitable location for residential development with regard to planning policy in respect of development in the countryside, character and appearance, highway safety and capacity and whether sufficient information has been provided in respect of flood risk.
