Land at Sunhill, Welsh Way, Poulton, Cirencester
The proposed development described as ‘a full planning application for the erection 20 dwellings (10 affordable & 10 open market) and associated development has been dismissed.
The main issues are:
•whether the appeal site is a suitable location in principle for residentialdevelopment;
•the effect of the proposal on the character and appearance of the area;
•whether the proposed development would make appropriate provision foraffordable housing; and
•whether there are any material considerations that would overcome anyharm resulting from the proposal
The application Ref 18/00970/FUL, dated 13 March 2018, was refused by notice dated 12 September 2018
Land at Bowlands Hey / The Fairways, Westhoughton, Bolton
The proposed development described as the erection of 174 dwellings, the laying out of roads and footways, hard & soft landscaping, walls and fences and drainage, together with the laying out of public open space including ecological mitigation; and other associated works has been dismissed.
The first reason for refusal informs that the adverse impacts which the Council consider would significantly and demonstrably outweigh the benefits are described within reasons 2, 3 and 4. Having withdrawn reasons 2 and 3 this leaves those adverse impacts specified in reason 4. This states that “the proposed development would have significant local landscape and visual impacts which would not maintain or respect the landscape character of the area or the landscape setting to the west of the Westhoughton Town Centre Conservation Area [CA]...” The Council clarified that the reference to the CA was not an assertion of harm to the setting of the CA.
Therefore the main issue is whether likely landscape and visual impacts of the development would satisfactorily safeguard the character and appearance of the site and locality with particular regard to landscape character.
I shall then go onto consider if any adverse impacts would significantly and demonstrably outweigh any benefits of the proposed development.
Land to south of Elizabeth Crescent, Whitehaven
The proposed development of residential development of up to 50 dwellings has been dismissed.
The main issue in this appeal is the effect of the proposed development onhighway safety in the vicinity of the appeal site.
The application Ref: 4/17/2296/0O1, dated 14 August 2017, was refused by notice dated 6 July 2018.
White Gables, Plas Newton Lane, Chester

The appeal is allowed and planning permission is granted for development of 42 dwellings comprised: 17 detached houses; 8 semi-detached houses; 11 terraced houses; 6 flats; garages; parking; landscaping; estate roads; junction access; footpaths; open space; play area; 5 allotments; and cycleway at landnext to School Lane, Milford on Sea, Lymington SO41 0TU in accordance with the terms of the application, Ref 17/10606, dated 18 April 2017, subject to the attached schedule of conditions
The Cabins, 78a Rochester Road, Aylesford
The development proposed is demolition of existing buildings, structures and hard standing, land raising of development area, development of up to 146 dwellings asa mix of houses and apartments and provision of a local centre for Use Classes A2(financial and professional services), A3 (café/restaurant), D1 (clinics/creche) and D2(assembly and leisure) up to a total floor space of 1,256 sq m (13,519 sq ft), and provision of new access road and pedestrian/cycle access, and provision of open space has been dismissed.

The main issue in the appeal is the effect of the proposal on the character and appearance of the area, including the effect on the settings of heritage assets
Former railway cutting between Walkley Terrace and Brunswick Street, Heckmondwike
The development proposed is described as “hybrid application with full planning consent for the engineered fill of the railway cutting and the formation of the urban greenway through the site running between Walkley Terrace and Brunswick Street, with outline consent sought for residential use of the new plateau with most matters reserved. Weseek consent for the new access off Horton Street and the spine road to adopted standard has been dismissed.

The main issues are the effect of the proposal on: (i) the character and appearance of the area; and (ii) the living conditions of nearby residents, with regards to privacy and overbearingness.
The application Ref 18/3030M, dated 18 June 2018, was refused by notice dated25 October 2018.

The proposed development described as ‘the erection of up to 22 dwellings with associated access and drainage infrastructure’ has been dismissed.
The main issue is whether the proposal benefits from the ‘presumption in favour of sustainable development’ set out at Paragraph 11 d) of the National Planning Policy Framework (‘the Framework)
