The proposed development of the erection of up to 200 dwellings with public open space, landscaping and sustainable drainage system and vehicular access point from Langaller Lane has been dismissed.

Taking into account the above and the evidence before me, the main issues are:

(1) whether the proposal would be acceptable having regard to the development plan’s strategy;

(2) the effect on the character and appearance of the area; and,

(3) whether any harm in relation to issues (1) and (2) above and any conflict with the development plan is outweighed by other material considerations.

The appeal is dismissed insofar as it relates to the northern parcel of the application site shown on drawing No 1004 within the S106 obligation dated 8 January 2019. The appeal is allowed insofar as it relates to the southern parcel of land as delineated by the red line on drawing No 1005, dated December 2018 and planning permission is granted for the erection of up to 190 dwellings, vehicular access to Old Norwich Road, public open space, and associated landscaping, engineering and infrastructure works at land west of Old Norwich Road, Ipswich IP1 6LH in accordance with the terms of the application (as amended) Ref: 1832/17, dated 10 May 2017, and subject to the conditions set out in the schedule at the end of this decision.

This appeal is allowed and planning permission is granted for demolition of existing dwellings and construction of 7×1 bed and 9×2 bed apartments with on-site parking and access off Braywick Road and Greenfields in accordance with the terms of the application, Ref 18/00263, dated 29 January 2018,subject to the conditions set out in the schedule at the end of this decision.

The appeal is allowed and planning permission is granted for demolition of former residential care home building and erection of 21 new dwellings, associated new access road, car parking and amenity areas on land at former Doubleday Lodge, Glebe Lane, Sittingbourne, Kent ME10 4LZ in accordance with the terms of the application Ref 18/500973/FULL, dated 15 February2018, subject to the conditions set out in the attached Schedule.

The appeal is allowed and planning permission is granted for construction of 23no. 2, 3 and 4-bed dwellings and associated car parking at Land off MarshlandRoad/Bloomhill Court, Moorends, Doncaster DN8 4PF in accordance with theterms of the application, Ref 15/00878/FULM, dated 13 April 2015, subject tothe conditions in the attached Schedule

The proposed development of residential development of 10 dwellings and associated works has been dismissed.

The main issues are;

– Whether the location is appropriate for residential development

– The effects on the character of the area

– The effects on the setting of the adjacent listed building

– Whether the proposed mix of dwelling types is acceptable

– Whether the council can demonstrate a suitable supply of housing sites and the consequent implications for the weight that its policies are given.

The development proposed is a hybrid application to include full planning application fora restaurant/pub with 150 covers with associated parking and landscaping andinstallation of plant at roof level and an outline planning application for 28 residentialunits with details of access submitted has been dismissed.

The Council refused the application for 3 reasons. The third related to the lackof a planning obligation to deal with affordable housing, travel plans, and firehydrants or other emergency water supplies. The other two reasons raiseconcerns about the effect of the residential development taking account of thefixed area for the restaurant/pub and the remaining space available. Havingregard to this background I consider the main issues to be:

•the effect of the residential development on the character andappearance of the area; and

•the effect of the residential development on the living conditions of theoccupiers of 7 Blackwater Rise and 15 Dorking Way in respect of privacy

The development proposed is the erection of 21 dwellings with associated parking, landscaping, open space and access has been dismissed. The decision supersedes that issued on 22 March 2018. That decision on the appeal was quashed by order of the High Court.

The main issues in this case are as follows:

•the effect of the proposed development on the setting of nearby listedbuildings; and the effect of the proposed development on the character and appearance of the area

The appeal is allowed and planning permission is granted for the erection of 48dwellings (use class C3), means of access, public open space and associatedinfrastructure. The permission is granted in accordance with the terms of theapplication Ref.18/0534/FUL, dated 4/4/18 and subject to the conditions in theSchedule below

The appeal is allowed and planning permission is granted for up to 55 dwellings(Use Class C3) and all associated parking, landscape and access and 1.56ha ofSuitable Alternative Natural Greenspace at land at Parklands, east ofBasingstoke Road, Spencers Wood, Wokingham in accordance with the termsof the application, Ref 171737, dated 8 May 2017, subject to the conditions setout in the attached schedule
