24-37 Riverside, Horton, Ilminster
The development proposed is the development of ten single storey dwellings with associated parking, garages and landscaping has been dismissed.
The appeal was made following the failure of the Local Planning Authority to determine the application within the requisite period. In its statement, the LP Aset out a putative reason for refusal which, in summary, was that the proposal would result in a cramped form of development and lead to the loss of protected trees, thus causing harm to the character and appearance of the area. However, it is clear from its statement that the LPA also regards the proposal as being harmful to the living conditions of existing and future occupiers and to highway safety. The main issues in this case are, therefore, the effects of the development on (i) the character and appearance of the area including protected trees (ii) the living conditions of future occupiers and those of neighbouring occupiers with respect to the adequacy of outdoor space,privacy and outlook and (iii) highway safety.
Land north of Stretton Close, Bradfield Southend, Reading, Berkshire
The appeal is allowed and outline planning permission is granted for 11dwellings on land north of Stretton Close, Bradfield Southend, Reading, Berkshire RG17 6EN, in accordance with the terms of the application, Ref 17/03411/OUTMAJ, dated 8 December 2017, and the plans submitted with it, subject to the conditions contained in the schedule of conditions set out below.
Oak Tree Nurseries, Stroude Road, Virginia Water
The development proposed is redevelopment of the former Oak Tree Nurseries site to consist of a residential care home facility (40 beds) together with an extra care development (up to 110 units comprising of apartments and cottages) all within use class C2; associated communal facilities; provision of vehicular and cycle parking together with all necessary internal roads and footpaths; provision of open space and associated landscape works; and ancillary works and structures has been dismissed.
The appellant accepts that the proposal would constitute inappropriate development in the Green Belt for the purposes of the National Planning Policy Framework (the Framework) and that openness would be harmed.
In light of the above, the main issues are:
(a) The extent to which the development would harm the openness of the Green Belt and/or conflict with its purposes;
(b) The effect on the character and appearance of the area;
(c) Whether the harm by reason of inappropriateness, and any other harm, is clearly outweighed by other considerations, so as to amount to the very special circumstances necessary to justify the development
Land off Cherry Tree Close, Yaxley, Suffolk
The development proposed is erection of 10 dwellings (including 6 affordable homes), 2flats and 1 retail unit has been dismissed because;
The main issues in this case are:
a)whether the site is a suitable location for residential development having regard to accessibility of services and facilities;
b)the effect of the proposal on the living conditions of existing residents in Cherry Tree Close, with regard to outlook, sunlight, privacy and noise;
c)whether the proposed development would make appropriate provision for surface water drainage;
d)whether a suitable mechanism is in place to secure the proposed affordable housing, future management of the open space within the scheme and adoption of the estate road; and
e) in light of my findings on the above matters and the Council’s housing land supply position, whether the proposal would constitute a sustainable form ofd evelopment.
Land north of Brindle Road, Bamber Bridge
