The development proposed was originally described as “Hybrid planning application compromising the following elements: Full application for the erection of a building to provide a new doctors surgery and dental practice (Use Class D1). Outline planning application with means of access to be considered for erection of up to 50 dwellings; erection of a two storey building (up to 800 sq m) to provide retirement living or use falling with Use Class C2. Change of use of land to provide a new area of open space including provision of new footpaths and sustainable drainage infrastructure has been dismissed.

The main issue is whether the proposed location would be appropriate, having regard to the council’s spatial strategy for growth and the character and appearance of the site and surrounding area.

The development proposed of the erection of up to 14 dwellings with associated residential curtilages, parking and turning areas and amendments to existing access and provision of new footway along Hurst Lane has been dismissed.

The main issues are:

•Whether the proposal would be inappropriate development in the Green Belt having regard to the National Planning Policy Framework and any relevant development plan policies;

• The effect of the proposal on the provision of storage and distribution premises;

• Whether there are other considerations weighing in favour of the proposal; and

• Would the harm by reason of inappropriateness, and any other harm, be clearly outweighed by other considerations. If so, would this amount to the very special circumstances required to justify the proposal.

The appeal is allowed and planning permission is granted for the proposeddemolition of the Trebarwith Hotel and construction of 6 townhouses, 9apartments, a detached dwelling with associated landscaping and car parkingand the change of use of No.47 and No.49 Trebarwith Crescent from hotel toresidential at Trebarwith Hotel, Trebarwith Crescent, Newquay TR7 1BZ inaccordance with the terms of the application, Ref: PA17/11528,dated 4 December 2017, subject to the conditions in the attached schedule

The appeal is allowed and outline planning permission is granted for up to 10dwellings at Land to the rear of Noke Common and Hogan Road, Newport, Isleof Wight in accordance with the terms of the application, Ref P/00463/17,dated 10 April 2017, subject to the conditions set out in the attached schedule

 I am directed by the Secretary of State to say that consideration has been given to thereport of Frances Mahoney DipTP PGDipTP MRTPI IHBC who held a public local inquiryon 5 to 7 September, 12 – 13 September and 9 – 12 January 2018 into your clientsappeal against the decision of Doncaster Metropolitan Borough Council to refuse yourapplication for planning permission for residential development (Use Class C3) with openspace, landscaping and associated access, in accordance with application ref:15/01278/OUTM dated 18 May 2015.

The Inspector recommended that the appeal be allowed and planning permission grantedsubject to conditions.

For the reasons given below, the Secretary of State agrees with the Inspector’s conclusions, except where stated, and agrees with her recommendation. He has decided to allow the appeal and grant planning permission, subject to conditions. A copy of the Inspector’s report (IR) is enclosed. All references to paragraph numbers, unless otherwise stated, are to that report.

The proposed development of the erection of 13 dwellings and access road has been dismissed, the main issue being whether any adverse impacts of the proposed development, having particular regard to the likely effect upon the character and appearance of the area, road safety interests and the accessibility to services and facilities would significantly and demonstrably outweigh the benefits of the proposal.

The appeal is allowed and planning permission is granted for residential development omprising 110 no dwellings and associated works including roads, sewers, public open space and landscaping at Land at the corner of Pentywyn Road and Marl Lane, Deganwy in accordance with the terms of the application, Ref 0/43059, dated23/06/2016, and the plans submitted with it, subject to the conditions set out in Schedule 1 below.

The proposed development of approximately 50 dwellings accessed from Moss Side Lane, with associated open space and landscaping has been dismissed because expressed concern about the nature of the access arrangements to the site

The development proposed is described as ‘residential development of 41 dwellings’ this has been dismissed. The application Ref 16/1028 is dated 21 December 2016.

The appeal is made by Wainhomes North West Ltd against Fylde Borough Council.

The proposed development of demolition of existing property and proposed erection of 11 new residential dwellings on land at the rear has been dismissed.

The main issues are:-

• the effect on the character and appearance of the area;

• the effect on the living conditions of adjacent occupiers with regard to noise and disturbance.
