The appeal is allowed and planning permission is granted for Proposed residential development of up to 29 dwellings at Blake Street, Maerdy, Ferndale CF43 4AH, in accordance with the terms of the application, Ref 18/0018/13, dated 24 August 2017,subject to the conditions set out in the schedule to this decision letter.

The proposed development of the erection of 97 houses with garages and/or parking spaces together with the provision of open space and associated roads and sewers has been dismissed. Main issues being the effect of the driveway surfacing proposed for the development on highway safety and the appearance of the area, with particular regard to the displacement and spillage of loose material.

The proposed development of four detached single storey dwellings has been dismissed, the main issue being the impact of the development upon highway safety with particular reference to vehicle movements at the junction of White Lodge Crescent and Frinton Road.

The proposed residential development has been dismissed, the preliminary matters are the application was made in outline with details of access provided and thoseover layout, appearance, landscaping and scale reserved for laterconsideration. I have dealt with the appeal accordingly. The submitted plan oftwelve detached dwellings, with Magdalen House retained and converted to sixflats, has been considered insofar as it is indicative of a possible layout andamount of housing also on 24 July 2018, since this appeal was made, Government published therevised National Planning Policy Framework (the Framework). Having grantedthe parties an opportunity to make further comment, my decision reflects this

The development proposed is residential development and access, all other matters reserved was dismissed.
With the provision of the UU, the Council did not seek to defend refusal reasons 3, 4, 5 and 6 (as given on its decision notice). Accordingly, from all that I have read, heard and seen the main issues are:
Whether the proposal would accord with the development plan strategy for the location of housing including having regard to (i) its effects on the character and appearance of the area; and (ii) whether it would provide satisfactory access to shops and services with particular regard to the availability of sustainable transport modes;
