The development proposed is the erection of up to 99 dwellings with public open space,landscaping and sustainable drainage system (SuDS) and vehicular access point fromHolwell Road, with all matters reserved except for means of access

In the light of the reasons for refusal of the planning application and of the SCG, I consider the main issue in the appeal to be whether the site would be suitable for the proposed development, having regard to national and local policy on the provision of rural housing, and in particular to:

 The site’s location outside the designated settlement boundary;

 The effect on the character and appearance of the area;

 The use of best and most versatile agricultural land;

 The site’s accessibility to services and facilities.

The development proposed is the erection of up to 40 homes, associated open space,local area of play and other infrastructure, with all matters reserved save for that of access.

From all I have read, heard and seen the main issues are:

Whether the proposal would accord with the development plan strategy for the location of housing including having regard to (i) its effects on the character and appearance of the area including the Chilterns Area of Outstanding Natural Beauty (AONB) and the form and character of Lewknor; and (ii) whether it would provide satisfactory access to shops and services with particular regard to the availability of sustainable transport modes.

Whether there are any other material considerations which would indicate that the proposals should be determined other than in accordance with the development plan

The development proposed of the erection of 27 no. 2, 3 and 4 bed houses withassociated parking and access road. Alteration to 175 Smallfield Road to facilitate newaccess road has been dismissed.

The main issues are:

 – the effect of the proposed dwellings on the intrinsic character and appearance of the rural area;

 – the effect of the proposed development on flood risk;

 – the effect of traffic and parking relating to the access to the proposed development on the safe         and efficient operation of the highway network in the vicinity of the appeal site; and

- whether or not the proposed development would make adequate provision for affordable housing.

The appeal is allowed and planning permission is granted for redevelopment of former scrapyard for the erection of 10 dwellings at Land adjacent to Fosse Lodge, The Fosse, Moreton in Marsh, in accordance with the terms of the application, Ref 18/00737/FUL, dated 23 February 2018, subject to the schedule of conditions attached to this decision.

The proposed development described as ‘residential development’ has been dismissed.

The main issue in this appeal is whether the proposal would be in a suitable location, having particular regard to the development plan and the character and appearance of the area.

Appeal A: The appeal is allowed and planning permission is granted for up to10 dwellings with all matters reserved except access at Land north of Abbey Lane, Aslockton, Nottinghamshire NG13 9AE in accordance with the terms of the application, Ref 17/02582/OUT, dated 30 October 2017, subject to the conditions set out in the attached schedule. 

Appeal B: The appeal is allowed and planning permission is granted for up to 6dwellings with all matters reserved except access at Land north of Abbey Lane, Aslockton, Nottinghamshire NG13 9AE in accordance with the terms of the application, Ref 18/01569/OUT, dated 2 July 2018, subject to the conditions set out in the attached schedule.

The proposed development of the erection of ten new-build dwellinghouses and the development of the erection of six no new-build dwellinghours and associated works have both been dismissed.

The main issues are:

- the effect of the proposed dwellings on the character and appearance of the surrounding area with particular regard to the setting of Hurst Wickham Conservation Area; and

- whether the proposals would be consistent with the settlement hierarchy set out in the DP.

The appeal is allowed and planning permission is granted for up to 155residential units and a 64-bedroom residential care home on land to the west ofClyst Road, Topsham, Exeter, Devon in accordance with the terms of theapplication, ref. 17/1148/OUT, dated 10 July 2017, subject to the conditionsset out in the schedule at the end of this decision

The appeal is allowed and planning permission is granted for 64 dwellings with roads, garages and residential parking including community parking and public pen spaces at land at Honey holes Lane, Dunholme, Lincolnshire in accordance with the terms of the application, Ref 136785, dated 18 September 2017,subject to the conditions set out in the attached Schedule.

The proposed application for the edevelopment to provide up to 29 dwellings (net increase of27 dwellings); demolition of 2 existing semi-detached dwellings, glasshouses and outbuildings; landscaping and highway works including alterations and extension to the existing access to Hedgehog Lane. Within this hybrid planning application:

Outline planning permission (with Layout, Scale and Appearance reserved and Access and Landscaping for approval) is sought for the erection of up to 28 new dwellings(Class C3), including extension and alterations to existing access from Hedgehog Lane, demolition of 2 existing semi-detached dwellings, glasshouses and outbuildings; and associated landscaping; and

Full planning permission is sought for the change of use and refurbishment of Longdene House from office (Class B1a) to residential (Class C3) to provide a new dwelling has been dismissed.

The Main issues in this appeal are the effects of the proposed development on;

– The character and appearance of the area and the AONB

– Highway safety

– Supply of housing land.
