Appeal A, the construction of up to 140 dwellings, new public open space, associated landscaping and site infrastructure on land south of Greenwood Avenue, Chinnor, Oxfordshire OX39 4HN (nearest) in accordance with the terms of the application Ref P16/S3284/O, dated 30 September 2016, and the plans submitted with it, subject to the conditions listed in Appendix A attached, and;

Appeal B, the demolition of 2 no dwellings and the construction of a new access road at 17 and 19 Greenwood Avenue, Chinnor, Oxfordshire OX39 4HNin accordance with the terms of the application P16/S3285/FUL dated 30September 2016 and the plans submitted with it subject to the conditions listed in Appendix B attached.

The appeal is allowed and outline planning permission is granted for outline planning application for a residential development of up to 43 dwellings, public open space, and associated infrastructure; on land off Westaway Plain, Pilton, Barnstaple. All matters reserved, save for access off Westaway Plain, at Land off Westaway Plain (west of Youings Drive) Barnstaple, in accordance with the terms of the application Ref 62736, dated 8 March 2017, subject to the conditions in the attached schedule.

I am directed by the Secretary of State to say that consideration has been given to the report of Richard Schofield BA (Hons) MA MRTPI, who held a public local inquiry starting on 23 April 2018, and which was closed in writing on 13 August 2018 (IR1.11), into your client’s appeal against the decision of Warrington Borough Council (“the Council”) to refuse your client’s application for outline planning permission for a new residential neighbourhood including C2 and C3 uses; local employment (B1 use); local centre including food store up to 2000m

2, A1-A5 (inclusive) and D1 use class units of up to 600m2 total (with no single unit of more than 200m2) and family restaurant/pub of up to 800m2 (A3/A4 use); site for primary school; open space including sports pitches with ancillary facilities; means of access and supporting infrastructure, in accordance with application ref: 2016/28492, dated 11 July 2016

On 25 July 2017, this appeal was recovered for the Secretary of State’s determination, in pursuance of section 79 of, and paragraph 3 of Schedule 6 to, the Town and Country Planning Act 1990.

The appeal is allowed and planning permission is granted for a development ofup to 70 dwellings together with associated access, public open space,landscaping and amenity areas on land at Satchell Lane, Hamble-le-Rice SO314HP in accordance with the terms of the application, Ref O/17/80319, dated 12April 2017, subject to the conditions set out at the end of this decision

The appeal is allowed and approval is granted under the provisions of section 78 of the Town and Country Planning Act 1990 for the appearance, landscaping, layout and scale of 84 new residential homes which includes affordable housing, a balancing feature, footway links, open space and associated works at Land East of Knightcote Road, Knightcote Road, Bishops Itchington, CV47 2SP in accordance with the terms of the application Ref 17/01884/REM, dated 31 May 2017 and the plans submitted with it, subject to the conditions in Annex A.

The appeal is allowed and planning permission is granted for an extra care development of 79 units (comprising of apartments and cottages) all within Use Class C2; associated communal facilities; provision of vehicular and cycle parking together with all necessary internal roads and footpaths; provision of open space and associated landscape works; and ancillary works and structures on land to the rear of 237-259 London Road, West Malling, Kent ME19 5AD in accordance with the terms of the application, Ref TM/17/00506/OA, dated 23 February 2017, subject to the conditions set out on the attached schedule

The proposed development of the ‘erection of 67no. dwellings, single anddouble garages, new vehicular access, associated parking and landscaping (demolitionof 121 Dover Road) amended details and plans received relating to car parking)’ has been refused. The application Ref DOV/17/00280 dated 8th March 2018 was refused by notice dated 9 November 2017.

The appeal is made by Ms K Putnam of Westerhill Homes against the decision of Dover District Council.

The main issues are:

 The effect of the proposed development on the character and appearance of the area; and

 Whether the proposal would provide an acceptable mix of housing; including the provision of affordable housing.

The proposed development of residential development has been dismissed.

The appeal is made by Mr E Costello of Chesside Homes Ltd against the decision of West Oxfordshire District Council. The application Ref 17/03717/OUT, dated 13 November 2017, was refused by notice dated 13 March 2018.

The main issues are

The effect of the proposal on the character and appearance of the area

The effect of the proposal on heritage assets;

Whether adequate access would be provided to the site; and

Whether the site is an appropriate location for the development

The appeal is allowed and planning permission is granted for up to twentyaffordable dwellings at Land off Saddler Avenue, Stone, Staffordshire inaccordance with the terms of the application, Ref 17/25759/OUT, dated10 February 2017, subject to the conditions contained in the schedule at theend of this decision

Appeal A of the development proposed is erection of 4 number four bedroom; 4 number threebedroom, and 2 number two bedroom houses and associated development includingrevised access, and provision of public footpath and retention and improvement of awildlife area and Appeal B of the development proposed is erection of: (i) Market housing: 4 number four bedroom;4 number three bedroom and 1 number two bedroom houses; (ii) Affordable housing:4 number three bedroom and 1 number two bedroom houses; (iii) associateddevelopment including revised access, and provision of public footpath, and(iv) retention and improvement of a wildlife area; both have been dismissed.

The main issues common to both cases are:

a) the effect of the proposals on the character and appearance of the area;

b) the effect of reducing the physical separation between Tokers Green and Reading on the character and identity of Tokers Green;

c) whether future occupiers of the proposed development would have safe access to services and facilities by transport modes other than the private car; and

d) whether, having regard to my findings on the above issues, the presumption in favour of sustainable development set out within the National Planning Policy Framework (the Framework) and any benefits arising from the proposed development, there are material considerations sufficient to outweigh any conflict with the Council’s distribution strategy for housing.
