The main issues being whether the proposed development would conserve and enhance the landscape and scenic beauty of the High Weald Area of Outstanding Natural Beauty (AONB), and the effect of the proposed development on the character and appearance of the settlement of Beckley and the area more generally, and whether the proposed mix of affordable housing would address the need to support mixed, balanced and sustainable communities.

The appeal is made under section 195 of the Town and Country Planning Act 1990 as amended by the Planning and Compensation Act 1991 against a refusal to grant a certificate of lawful use or development (LDC). The development proposed is demolition of existing redundant stores, change of use of builder’s yard and redevelopment of quarry site to provide 43 No dwellings, including 14 affordable homes has been dismissed. The application Ref DC/15/3673, dated 9th September 2015 was refused by notice dated 4 November 2016. The appeal is made by M S Oakes Limited against the decision of Suffolk Coastal District Council.
Land west of Stalbridge Road, Henstridge
The appeal is allowed and planning permission is granted for up to 130dwellings with public open space, landscaping, sustainable drainage system and vehicular access point from Woodhayes Way at land west of Stalbridge Road, Henstridge in accordance with the terms of the application, Ref17/03029/OUT, dated 18 July 2017, subject to the conditions set out in the attached Schedule.
Land at Silverdale Avenue, Guiseley
The development proposed is the erection of 46 dwelling houses, formation of access road and associated landscaping has been refused. The application ref 17/01262/FU, dated 27 Feb 2017 was refused by notice dated 19 January 2018. The appeal is made by Mr Martin Acott of Stonebridge Homes against the decision of Leeds City Council.
Land at Deerlands Road, Wingerworth
The appeal is allowed and planning permission is granted for a residential development of up to 180 dwellings, public open space, landscaping, highway and drainage works and associated infrastructure on land at Deerlands Road, Wingerworth in accordance with the terms of the application, Ref 17/00268/OL, dated 3 March 2017, subject to the conditions appended to this decision.
Land to the West of Station Road between nos. 12 and 14 Station Road, Steeple Morden
The proposed development of up to 12 dwellings with all matters reserved except access has been dismissed. The application Ref S/3428/17/OL dated 28 September 2017 was refused by notice dated 25 April 2018. The appeal is made by Steeplefield Ltd against the decision of South Cambridgeshire District Council.
Land at Farleigh Road, Farleigh Road, Cliddesden, Hampshire
The proposed development of the erection of 40 dwellings to include 24 private homes and 16 affordable homes, associated parking, landscaping, amenity space and highway alterations has been dismissed because Policy SS1 of the Basingstoke and Deane Local Plan 2011-2029 (LP) outlines the local strategy for housing delivery and directs new development towards the area’s defined settlement boundaries. Furthermore, Policy SS6 of the LP permits proposals outside these areas only in a small number of defined circumstances.The appeal site is located outside but immediately adjacent to the recognised settlement boundary of Cliddesden. It does not include previously developed land, form part of a rural exception site for affordable housing, or involve the re-use or replacement of an existing building or dwelling. Similarly, it does not consist of small scale residential development and the site has not been allocated in a made neighbourhood plan also in the absence of any identified exemption, I agree with the main parties that the proposal would be in conflict with LP Policies SS1 & SS6.
