The proposed development of residential development forming 21 dwellings has been dismissed, main issue being whether the appeal site would be a suitable location for the proposed development having regard to the spatial strategy forthe Borough, the effect of the proposal on the character and appearance of thecountryside and landscape, and its effect on the operation of the Parish Room.

The appeal is made by Mr A Cartwright of Cartwright Homes Limited against the decision of Hinckley & Bosworth Borough Council

The proposed development of residential development to provide 120 new homes,including 36 affordable homes, together with new vehicular and pedestrian access, internal access roads, car parking, landscaping, provision of 0.84 hectares of open space and a locally equipped area for children’s’ play (LEAP) and the removal of vehicular rights over most of by-way ES10 Black Lane has been dismissed. The main issues being the effect of the development on reptiles as protected species, the effect of the development on the operation of the local highway network and whether the development alone or in combination with other development in the area would be likely to have a significant effect for the designated habitats; and if so whether the effects would be capable of being acceptably mitigated.

The appeal is made by Abbey Developments Limited against Dover District Council

The proposed development for residential development has been dismissed. The application Ref 3/2016/1192, dated 21 December 2016 was refused by notice dated 18 April 2017. The appeal is made by the Trustees of Hammond Ground against the decision of Ribble Valley Borough Council.

The development proposed of outline application (including access) for the erection of up to 25 dwellings has been refused. The application ref 17/00700/1, registered on 4 May 2017, was refused by notice dated 21st July 2017. The appeal is made by Mr Jordan Day of Arbora Homes against the decision of North Hertfordshire District Council.

The development proposed is the construction of 18 no. two bedroom residential apartments, including upgrade to access lane. The application Ref PA17/05454 dated 9 June 2017 was refused by notice dated 19 December 2017. The appeal is made by Oceans Reach (Truro) Ltd against the decision of Cornwall Council.

The development proposed of residential development of up to 245 residential dwellings (including up to 40% affordable housing), structural planting and landscaping, informal public open space and children’s play areas, vehicular access from Peppard Road and Kiln Road and associated ancillary works has been refused.  The application Ref P16/S3630/O dated 31 October 2016, was refused by noticed dated 14 September 2017. The appeal is made by Gladman Development Ltd against the decision of South Oxfordshire District Council.

The appeal is allowed and outline planning permission is granted for up to 16dwellings with all matters reserved apart from access at site between Tynedale and Dyke House to the north of The Avenue, Medburn, Northumberland in accordance with the terms of the application, Ref 16/03778/OUT, dated7 October 2016, subject to the conditions set out in the schedule attached to this decision letter.

The development proposed of the erection of 30 dwellings with access from Bury Lane, including affordable housing, open space, children’s play area and drainage basin has been refused. The application Ref 17/01107/FUM, dated 21 June 2017 was refused by notice dated 19 October 2017. The appeal is made by Laragh House Developments Ltd against the decision of East Cambridgeshire District Council.

The development proposed development of 20 new dwellings consisting of a mixture of 1 and 2 storey buildings on existing land at Stockbridge Road, Clifton. The application Ref CB/17/05643/FULL, dated 23 November 2017 was refused by notice dated 16 March 2018. The appeal is made by Mr Peter Moore of Wheatley Group Developments Limited against the decision of Central Bedfordshire Council.

The development proposed of demolition of existing residential dwellings and outbuildings and the layout and erection of 18 dwellings, gardens and open space has been refused. The application Ref 16/06046/FU, dated 27 September 2016 was refused by notice dated 31 July 2017. The appeal is made by Mr Alec Colgan (AC developments Yorkshire Ltd) against the decision of Leeds City Council.
