Appeal A – The appeal is dismissed and outline planning permission has been refused for a residential development including parking, access and open space on land east of Darvel Down and north of Netherfield  Road, Netherfield, Battle. The application Ref RR/2016/2722/P, dated 18 October 2016, was refused by notice dated 9 February 2017. The appeal is made by Park Lane Homes (South East) Limited against the decision of Rother District Council.

Appeal B – The appeal is dismissed and outline planning permission has been refused for a residential development including parking, access and open space on land east of Darvel Down and north of Netherfield  Road, Netherfield, Battle. The application Ref RR/2017/1146/P, dated 14 May 2017, was refused by notice dated 21 August 2017. The appeal is made by Park Lane Homes (South East) Limited against the decision of Rother District Council.

The appeal is allowed and planning permission is granted for a residential development of 33 dwellings with a mix of 2, 3 and 4 bed properties, and including 8 semi-detached units and 2 detached bungalows at 1 Walkeringham Road, Beckingham DN10 4PL in accordance with the terms of the application, Ref 16/00877/FUL, dated 23 June 2016, subject to the conditions in the attached schedule. The appeal is made by Mr Russ Jones of J & W Property Developments Ltd against the decision of Bassetlaw District Council.

The appeal is dismissed and outline planning permission has been refused for the erection of 11 new dwellings including 3 new affordable bungalows with new access from Mow Hill, Witnesham. The application Ref DC/17/1661/FUL, dated 18 April 2017, was refused by notice dated 1 June 2017. The appeal is made by Executor of Mr G Templeman (deceased) against the decision of Suffolk Coastal District Council.

The appeal is dismissed and outline planning permission has been refused for the erection of 25 dwellings on land off Brook Street, Hemswell. The application Ref 136184, dated 29 April 2017, was refused by notice dated 2 August 2017. The appeal is made by M & M Fieldson against the decision of West Lindsey District Council.

The appeal is dismissed and outline planning permission has been refused for ‘partial demolition of existing extensions and conversion of former Tatton Arms public house to create 9 No. new residential apartments (C3) and development in its grounds comprising 14 No. new homes (C3) and riverside café(A3) with associated access, parking and landscaping’. The application Ref 113823/FO/2016, dated 26 August 2016, was refused by notice dated 10 March 2017. The appeal is made by Britannia Group against the decision of Manchester City Council.

The appeal is dismissed and outline planning g permission has been refused for the erection of 40 dwellings (14 x 2 bed, 8 x 3-bed and18 x 4-bed) with associated landscaping and parking, and change of use of land to public open space on land to the east of the Pentlands, Kintbury. The application Ref 17/00981/OUTMAJ, dated 31 March 2017, was refused by notice dated 26 July 2017.

The appeal is dismissed and outline planning permission has been refused for a residential development for up to 60 dwellings, of which 50% will be affordable housing within the meaning of the glossary to the National Planning Policy Framework; demolition of no 1 Bretforton Road, new access from Bretforton Road. The application Ref 17/01687/OUT, dated 14 August 2017, was refused by notice dated14 November 2017. The appeal is made by Oxford Law against the decision of Wychavon District Council.

The appeal is dismissed and outline planning permission has been refused for the erection of up to 140 dwellings, the demolition of outbuildings, with public open space, landscaping and sustainable drainage system, and vehicular access from Newton Road. The application Ref 37/17/00052, dated 13 May 2017, was refused by notice dated 20 September 2017. The appeal is made by Gladman Developments Limited against the decision of Sedgemoor District Council.

The appeal is dismissed and outline planning permission has been refused  for a  mixed use development comprising uses within some or all of Classes C3 (Residential), Offices (Class B1), Gymnasium (Class D2), Crèche (Class D1), Café (Class A3) and Hotel (Class C1), with associated car parking, means of access, access roads, infrastructure works and landscaping. The application Ref 16/P/0329/O, is dated 23 December 2015. The appeal is made by Ms Donna Wall (Moor Park (North Somerset) Ltd) against North Somerset Council.

The appeal is allowed and outline planning permission is granted for residential development with means of access at Land south of Pool Road, Pool in Wharfedale, Leeds in accordance with the terms of the application, Ref 17/02068/OT, dated 29 March 2017, subject to the sixteen conditions which are appended to this decision letter.
