Accordingly, for the reasons given above, the Secretary of State agrees with the Inspector’s recommendation. He hereby dismisses the appeal and refuses planning permission for a mixed use sustainable urban extension comprising up to 970 dwellings, including affordable housing, a local centre/community hub, a primary school, public open space, structural landscaping and the provision of vehicular, cycle and pedestrian access, car and cycle parking and facilities for public transport in accordance with application ref: N/105/01376/13 at land north-east and south-west of the B1200 (Legbourne Road), Louth, Lincolnshire, LN11 8LC. The appeal is made by Gladman Developments Ltd against the decision of East Lindsey District Council.
Land off St Cyriac, Luxulyan, Cornwall, PL30 5EF
The appeal is invalid. The application details (taken from the summary on the appeal form) were: “With respect to the S106 Agreement dated 23 November 2009 and Cornwall Council consent 08/01791 which permitted the development of 13 affordable houses and 6 speculative houses. It is proposed that the number of affordable houses be reduced from 13 to 10, and the number of open market houses be increased from 6 to 9, by allowing plot numbers 14, 15 and 16 to be delivered as open market housing (rather than affordable housing).
