Accordingly, for the reasons given below, the Secretary of State disagrees with the Inspector’s recommendation. He hereby dismisses your client’s appeal and refuses planning permission for a residential development of up to 350 dwellings, local centre of up to 700 sq. m of Class A1 retail use, open space, access roads, cycleway, footpaths, landscaping and associated engineering works, in accordance with application ref: E/2013/0083/OUT, dated 23 January 2013.

The appeal is dismissed and planning permission is refused for the residential development of up to 70 dwellings (Class C3) Green Infrastructure to include: retained vegetation; habitat creation (including new woodland planting); open space, amenity space and play areas; sustainable drainage systems/features; and new walking/cycling/recreational routes. Infrastructure to include highway and utilities and associated engineering works (including ground modelling) and vehicular access via the construction of a new junction off the existing Lower Packington Road. The application Ref 13/00694/OUTM, dated 16 August 2013, was refused by notice dated 7 January 2014.

The appeal is allowed and outline planning permission is granted for 110 dwellings; access to be taken from High Street, Linton; 50 High Street to be demolished for access purposes at land at 50 High Street, Linton, Swadlincote, Derbyshire, DE12 6QL in accordance with the terms of the application Ref 9/2013/0689, dated 21 August 2013, and the plans submitted with it, subject to the conditions set out in the attached schedule below.

The appeal is dismissed and planning permission is refused for the construction of 21 new houses at the Land to the rear of 1-6 Smedley Crooke Place, Redditch Road, Hopwood, Bromsgrove, B48 7TP.

The appeal is allowed and planning permission is granted for the construction of 15 dwellings and associated vehicular access at Bowden Hall Farm, Bondend Road, Upton St. Leonards, Gloucester GL4 8ED, in accordance with the terms of the application, Ref.S.13/1844/OUT, dated 20 August 2013, subject to the conditions listed in Annex A to this decision.

The appeal is dismissed and outline planning permission is refused for the residential development land adjacent to Little Treasures day nursery at Broomhall Grange, Norton Road, Broomhall, Worcester, WR5 2PD. The application Ref. 13/00710/OUT, dated 4 June 2013, was refused by notice dated 21 October 2013.

The appeal is allowed and planning permission is granted for the demolition of No 346 Barkham Road and the erection of 25 No dwellings (24 net) together with new vehicle and pedestrian access from Barkham Road on land to the rear of 336-350 Barkham Road, Wokingham, Berkshire, RG41 4DE, in accordance with the terms of the application, Ref F/2013/1483, dated 25 July 2013, subject to the conditions set out in the Schedule appended to this decision.

The appeal is allowed and planning permission is granted for the construction of 30 dwellings (6 bungalows and 24 houses) at land off Heritage Green, Kessingland, Lowestoft, Suffolk NR33 7UP in accordance with the terms of the application, Ref DC/12/1105/FUL, dated 18 September 2012, subject to the conditions in the Conditions Schedule below.

The appeal is dismissed and outline planning permission is refused for the low density residential development comprising 16 dwellings, a mixture of houses and bungalows at School Brow, Brigham, CA13 0TR. The application Ref 2/2013/0600, dated 26 June 2013, was refused by notice dated 26 February 2014.

The appeal is dismissed and outline planning permission is refused for the erection of up to 32 dwellings and associated works at the Land at Albany Drive, Salesbury, Copster Green, BB1 9EH. The application Ref 3/2014/0307, dated 31 March 2014, was refused by notice dated 27 June 2014.
