Appeal A

The appeal is dismissed and planning permission is refused for the residential development of 70 houses with associated access, landscaping and infrastructure (phase1) at the Land east of Springwell Lane, Whetstone, Leicestershire LE8 6LT. The application Ref 10/0856/1/PX, dated 28 October 2010, was refused by notice dated 6 February 2012.

Appeal B

The appeal is dismissed and planning permission is refused for the residential development for up to 108 houses with associated access, landscaping and infrastructure (outline)(phase 2) at the Land east of Springwell Lane, Whetstone, Leicestershire LE8 6LT. The application Ref 10/0857/1/OX, dated 28 October 2010, was refused by notice dated 6 February 2012.

The appeal is dismissed and planning permission is refused for the formation of access for use by construction traffic inconjunction with proposed residential development at the Land off Countesthorpe Road and Springwell Lane, Whetstone, Leicestershire.  The application Ref 11/0523/1/PY, dated 20 July 2011, was refused by notice dated 6 February 2012.

Accordingly, for the reasons given below, the Secretary of State agrees with the Inspector’s recommendation. He hereby dismisses the client’s appeal and refuses outline planning permission for residential development and a crèche at the Land off Waddington Road, Clitheroe, Lancashire, BB7 2DE in accordance with application ref: 3/2012/0913, dated 5 October 2012.

The appeal is allowed and planning permission is granted for the erection of 116 No two, three, four and five bedroom dwellings and 21 No one bedroom bungalows, together with associated landscaping, open space, drainage infrastructure, car parking and access roads at Mitton Road, Whalley, Lancashire in accordance with the terms of the application, Ref: 3/2012/0637, dated 18 July 2012 and subject to the schedule of conditions set out in the attached Annex.

The appeal is allowed and planning permission is granted for a mixed-use development consisting of up to 75 dwellings (including affordable dwellings), 675 sqm (GIA) B1 a, b, c employment, 230 sqm (GIA) D1 multi-purpose community building, access, school expansion area, public open space and allotments at Land east of Slades Hill, Templecombe, Somerset BA8 0HE, in accordance with the terms of the application, Ref 12/03277/OUT, dated 13 August 2012, subject to the conditions listed at Annex A.

The appeal is dismissed and outline planning permission is refused for the erection of 23 affordable housing units, together with access, parking and landscaping at the Land rear of 99-119 Whyteladyes Lane, Cookham, Berkshire SL6 1RL. The application Ref 13/00834, dated 23 March 2013, was refused by notice dated 26 June 2013.

The appeal is allowed and planning permission is granted for sixty one residential dwellings, with associated vehicular and pedestrian access, landscaping, site re-grading and related infrastructure and engineering works at Land at Mitchell Gardens, Chard, Somerset, TA20 1QU in accordance with the terms of the application, Ref 11/04212/FUL, dated 17 October 2011, and
the plans submitted with it, subject to the conditions contained within the attached schedule.

The appeal is dismissed and outline planning permission is refused for the development of 20 dwellings, comprising 10 private and 10 affordable dwellings, with associated private amenity space and parking at the land at Summerfold, Rudgwick, Church Street, Horsham, RH12 3BY. The application ref. DC/12/2232, dated 28 November 2012, was refused by notice dated 13 March 2013.

The appeal is allowed and outline planning permission is granted for up to 78 residential units, associated ground preparation works, associated highway and access works, and the first phase of the Sandgate Country Park at the former RMC Engineering Works, Storrington Road, Washington, West Sussex in accordance with the terms of the application, Ref DC/10/1457, dated 16 July 2010, subject to the conditions set out in the attached schedule.

Accordingly, the Secretary of State disagrees with the Inspector’s recommendation and hereby dismisses the client’s appeal and refuses outline planning permission for the erection of 111 dwellings, a sports hall, a neighbourhood centre, sports pitches and associated parking, open space, access and landscaping at the Land South of Hallbrook Primary School, Crowfoot Way, Broughton Astley, Leicestershire in accordance with application ref: 12/00494/OUT.
