The appeal is allowed and planning permission is granted for the erection of 37 dwellinghouses with associated new access and landscaping at land to the east of Coastal Road, Bolton-le-Sands, Lancashire in accordance with the terms of the application, Ref 13/00029/FUL, dated 11 January 2013 subject to the conditions set out in the attached schedule.

The appeal is dismissed and outline planning permission is refused for the development of “up to 135 dwellings with all matters reserved” for the Land at Hunting Butts Farm, Swindon Lane, Cheltenham, Gloucestershire, GL50 4NZ. The application Ref 11/00257/OUT, dated 11 February 2011, was refused by notice dated 13 May 2011.

The appeal is dismissed and outline planning permission is refused for the erection of 116 dwellings and 72 bed care home and formation of new accesses to Harpenden Road, 2 tennis courts and public open space in Sewell Park, land rear of 112-156b Harpenden Road, St Albans, AL3 6BZ. The application Ref 5/11/2857, dated 18 November 2011, was refused by notice dated 10 February 2012.
Land off Cherry Hill, Chiswell Green, St Albans
The appeal is dismissed and planning permission is refused for the redevelopment of the Land off Cherry Hill, Chiswell Green, St Albans to provide 14 residential dwellings along with associated parking and amenity space. The application Ref 5/13/2188, dated 12 August 2013, was refused by notice dated 15 November 2013.

The Secretary of State agrees with the Inspector’s recommendation and hereby allows the client’s appeal and grants outline planning permission with all matters reserved save for means of access, for residential development of up to 400 dwellings (including retirement dwellings), highway works, site for community use (Class D1), public open space, children’s play area, landscaping, drainage and associated infrastructure for the Land South of Humberston Avenue, Humberston, North East Lincolnshire, in accordance with planning application ref: DC/107/12/HUM, dated 13 February 2012, subject to the conditions listed at Annex A of this letter.

Accordingly, the Secretary of State agrees with the Inspector’s recommendation. He hereby allows the client’s appeal and grants planning permission for a mixed use redevelopment comprising: site clearance and remediation works including the demolition of existing buildings and structures; up to 660 dwellings; up to 71,533 sq. metres of employment floorspace; a local centre providing up to 600 sq. metres of floorspace together with associated car parking, servicing, landscaping, public realm works and works to the highway; public open space; sports and recreation facilities; structural landscaping; re-profiling of the River Trent and Tatenhill Brook and provision of drainage ponds and flood alleviation works; and internal highway network to include the provision of access junctions to the A38 and Main Street at land South of Lichfield Road, Branston, Burton upon Trent, Staffordshire, in accordance with application reference P/2011/01243/JPM, dated 24 October 2011, subject to the conditions listed in Annex A to this letter.

Accordingly, for the reasons given above, the Secretary of State agrees with the Inspector’s recommendations. He hereby allows your clients’ appeal and grants outline planning permission for the erection of up to 250 dwellings, associated structural landscaping including woodland planting, public open space, access, drainage, associated infrastructure, earthworks and other ancillary and enabling works including the demolition of all buildings at land at Red House Farm, Lower Outwoods Road, Burton-upon-Trent, Staffordshire, DE13 0QX in accordance with application Ref: P/2012/01215.
