Accordingly, the Secretary of State agrees with the Inspector’s recommendation. He hereby allows the client’s appeal and grants outline planning permission for up to 75 residential dwellings, landscape, open space, highway improvements and associated access at Land off Barford Road, Bloxham, Oxfordshire, in accordance with application Ref 12/00926/OUT, dated 25 June 2012, subject to the conditions listed at Annex A of the letter.
Land off Elmwood Avenue, Essington
The appeal is allowed and planning permission is granted for residential development comprising the erection of 28 dwellings and garages with associated roads, drainage, landscaping and other accommodation works at Land off Elmwood Avenue, Essington, WV11 2DH in accordance with the terms of the application, Ref 11/00929/FUL, dated 23 November 2011 and the plans submitted with it, subject to the conditions listed in the Conditions Schedule.
The Bungalow, Kiln Lane, Brockham, Betchworth
The appeal is dismissed and outline planning permission is refused for the erection of 45No dwellings at The Bungalow, Kiln Lane, Brockham, Betchworth RH3 7LZ. The application Ref MO/2012/0973/OUTMAJ, dated 11 July 2012, was refused by notice dated 19 July 2012.
Land at the Woodgate Centre, Woodgate Road, Westergate, West Sussex
The appeal is dismissed and outline planning permission is refused for the erection of up to 100 dwellings [including 30% (up to 30) affordable] together with 7,115 square metres of landscaped open space within the residential area and an additional 1.95 hectares of land to be laid out as publicly accessible amenity woodland, at the Land at the Woodgate Centre, Woodgate Road, Westergate, West Sussex, PO20 3GU. The application Ref AL/69/11/, dated 2 July 2011, was refused by notice dated 29 September 2011.
Land north of Yapton Road and east of Garden Crescent, Barnham
The appeal is allowed and outline planning permission is granted for up to 44 dwellings, including 30% affordable, comprising a mix of accommodation ranging from 2 – 4 bedroom houses with associated landscaping and works at Land north of Yapton Road and east of Garden Crescent, Barnham PO22 0AR in accordance with the terms of the application, Ref BN/7/12, dated 20 March 2012, and the plans submitted with it, subject to the conditions set out in the attached schedule.
Greenfields Lane, Malpas, Cheshire
The appeal is allowed and planning permission is granted for residential development of 7 dwellings (including 3 affordable housing units) at land off Greenfields Lane, Malpas, Cheshire, SY14 8HF in accordance with the terms of the application, Reference 12/03056/FUL, dated 3 July 2012, subject to the conditions set out in the Schedule to this decision.
Chester Road and Well Street, Malpas, Cheshire
The appeal is allowed and outline planning permission is granted for residential development for up to 140 dwellings, landscape, open space, access, highway improvement and associated works at Chester Road and Well Street, Malpas, Cheshire in accordance with the terms of the application, Ref 12/04687/OUT, dated 18 October 2012, subject to the conditions in the Conditions Schedule below.
Peters Road, Locks Heath, Hampshire
The appeal is allowed and planning permission is granted for the erection of 206 no. dwellings (including affordable housing), together with new vehicle and pedestrian access, associated car parking, landscaping and open space at land to the south of Peters Road, Locks Heath, Hampshire in accordance with the terms of the application, Ref P/12/0717/FP, dated 9 July 2012, subject to the conditions in the attached schedule.
Coastal Road, Bolton-le-Sands, Lancashire
The appeal is allowed and planninu g permission is granted for the erection of 37 dwelling houses with associated new access and landscaping at land to the east of Coastal Road, Bolton-le-Sands, Lancashire in accordance with the terms of the application, Ref 13/00029/FUL, dated 11 January 2013 subject to the conditions set out in the attached schedule.
Newlands Road, Luton, Bedfordshire
The appeal scheme as comprising 163 two bedroom flats/maisonettes, 50 three bedroom flats/maisonettes, 4 one bedroom flats/maisonettes and 13 four bedroom dwelling houses (230 units in total). Although this is an outline application with all matters, other than access and layout, reserved for future consideration, it was agreed, at the start of the Inquiry, that permission was being sought for this quantum of development, with the Council confirming that it had dealt with the application on that basis. I shall do the same. Moreover, although maximum building heights could be controlled by condition, were the appeal to succeed (as the application is in outline) it was confirmed for the appellant that, in order to provide the accommodation proposed within the layout shown, the buildings would need to be in general accordance with the scales and heights shown on the submitted plans.
