The development proposed for the erection of 18 dwellings (12 affordable dwellings and 6 open market dwellings) and associated access road, parking and open space has been dismissed.

The appeal is made by Naver Developments Ltd against the decision of Cornwall Council.

The application Ref is PA22/02389.

The development proposed for an outline planning application with all matters reserved apart from access, for residential development (up to 14 dwellings), vehicle circulation and parking, hard and soft landscaping and associated development has been dismissed.

The appeal is made by SLA Property Company Limited against the decision of Maldon District Council.

The application Ref is OUTM/MAL/23/00220.

The development proposed for an outline planning application for the erection of up to 190 dwellings (Use Class C3) formal and informal open space, landscaping, works and means of access has been dismissed.

The appeal is made by Caddick Land against the decision of North Yorkshire Council.

The application Ref 2022/0738/OUTM, dated 17 June 2022, was refused by notice dated 9 November 2023.

The appeal is allowed and planning permission is granted for a residential development of up to 132 dwellings at High Knocke Farm, Dymchurch Road, Dymchurch, Romney Marsh TN29 0PU in accordance with the terms of the application, Ref 21/2525/FH, subject to the conditions.

The appeal is allowed and planning permission is granted for construction of 15 no. dwellings with associated access, car parking and landscaping at Land to the East of Ivy Way, Spaldwick, PE28 0UN in accordance with the terms of the application, Ref 23/00649/FUL, and the plans submitted with it, subject to the conditions.

The appeal is allowed and planning permission is granted for construction of 104 dwellings (reserved matters of access, landscaping, layout and scale in relation to an outline approval – Planning Reference 20/00844/OUT) at the Former Lynncroft Primary School, Lynncroft, Eastwood, Nottinghamshire HG16 3FZ in accordance with the terms of the application Ref:22/00894/REM,  dated 18 November 2022, and subject to the conditions.

Accordingly, for the reasons given above, the Secretary of State agrees with the Inspector’s recommendations. She hereby allows all four of your clients’ appeals and grants planning permission for the following developments:

Appeal A Demolition of existing buildings adjacent to B6532 and outline planning permission (all matters reserved except for access) for a maximum of 1,550 residential dwellings (Use Class C3), a local centre (Use Classes E and F2), public house (Use Class Sui Generis) and primary school (Use Class F1), compensatory improvements to the Green Belt, associated infrastructure and landscaping, subject to the conditions.

Appeal B Outline planning application (with all matters reserved apart from access) for the development of up to 370 dwellings, an extension to Sniperley park and ride, demolition of former farm buildings and associated infrastructure works, subject to the conditions.

Appeal C Conversion of existing farm buildings to form 4no. residential units (Use Class C3) (Resubmission), subject to the conditions.

Appeal D Hybrid planning application consisting of outline planning permission (all matters reserved) for an extension to the Sniperley Park and Ride and full planning permission for the development of 368 dwellings associated access and works and demolition of former farm buildings (resubmission), subject to the conditions.

The development proposed was described as Outline planning application for the development of up to 455 new homes, a new multi-use community hall, land for the provision of a healthcare facility, land for a stand-alone early years and childcare nursery, new vehicular/pedestrian access points from Stadium Way in the north and Daws Heath Road in the south, new greenways and green links, multi-functional open space, green infrastructure, surface water attenuation, landscaping and associated infrastructure. All matters reserved except access has been dismissed.

The appeal is made by Mr Mark Sperrin of This Land Development Limited against the decision of Castle Point Borough Council.

The application Ref is 23/0085/OUT.

The appeal is allowed and planning permission is granted for an outline planning application (with all matters reserved except for access) for up to 350 dwellings, up to 4400 sq m of commercial and services floorspace (Use Classes E and B8) and up to 500 sq m of retail floorspace (Use Class E) and other associated works including drainage, access into the site from the A10 and Luynes Rise (but not access within the site), allotments, public open space and landscaping at land east of the A10, Buntingford, Hertfordshire in accordance with the terms of application reference 3/23/1447/OUT and the conditions.

The appeal is allowed and outline planning permission is granted for an outline planning application (with all matters reserved except for means of access) for the erection of up to 43 residential dwellings, including affordable housing, public open space, landscape planting, sustainable drainage system and new access arrangements from New Yatt Road at Land to the South of New Yatt Road, North Leigh OX29 6TH in accordance with the terms of the application, Ref 23/00794/OUT, and the plans submitted with it, subject to the conditions.
