The development proposed an Outline Planning Application for Residential Development for up to 74 Dwellings, including Access, with all other matters reserved has been dismissed.

The appeal is made by Land Allocation Ltd against the decision of Thanet District Council.

The application Ref OL/TH/21/0941, dated 3 June 2021, was refused by notice dated 23 February 2022.

The development proposed an outline planning application of up to 45 dwellings, to include 40% affordable dwellings (7 one bed homes, 5 two bed homes and 6 three bed homes),  infrastructure and open space. (All matters reserved other than access) has been dismissed.

The appeal is made by Barwood Homes Limited against the decision of West Northamptonshire Council.

The application Ref DA/2020/0479, dated 11 June 2020, was refused by notice dated 8 November 2022.

The development proposed a demolition of existing dwelling house, stables and barn and the erection of 12 new replacement dwellings and garages has been dismissed.

The appeal is made by Mr Mark Bristow of Burgundy Developments Ltd against the decision of Buckinghamshire Council – North Area (Aylesbury).

The application Ref 22/00979/AOP, dated 17 March 2022, was refused by notice dated 7 November 2022.

The development proposed for 20 dwellings and all other associated infrastructure including access, drainage and public open space has been dismissed.

The appeal is made by Allison Homes Ltd against the decision of North Northamptonshire Council.

The application Ref KET/2020/0369, dated 4 June 2020, was refused by notice dated 21 July 2022.

The appeal is allowed and planning permission is granted for the erection of 68 dwellings with associated access, drainage, parking, landscaping and infrastructure works at land to the north of Bishops Lane, Ringmer, RH14 9GN in accordance with the terms of the application, Ref LW/21/0694, dated 23 August 2021, and the plans submitted with it, subject to the conditions.

The development proposed for an outline planning application for residential development including means of access with all other matters reserved has been dismissed.

The appeal is made by Land Allocation Ltd against the decision of Mendip District Council.

The application Ref 2022/0617/OUT, dated 4 March 2022, was refused by notice dated 24 June 2022.

The appeal is allowed and planning permission granted for an outline application (with all matters reserved except for access) for the erection of up to 210 residential dwellings (class C3) and a 70-bed care home (class C2) with associated access, landscaping and open space, in accordance with the details submitted with planning application Ref: PL/2022/08504 on land South of Western Way, Melksham, Wiltshire (Easting 390741 Northing 162689), subject to the conditions.

The development proposed for an ‘Outline planning application for up to 150 residential dwellings including up to 40% affordable housing, creation of new vehicular access off of Thame Road and provision of public open space including a children’s play area with associated infrastructure and earthworks. All matters reserved except accessibility to the site, for vehicles in terms of the  positioning and treatment of access to the site (as updated by additional information 24 January, 1 March and 6 March 2023)’ has been dismissed.

The appeal is made by Gleeson Land against the decision of South Oxfordshire District Council.

The application Reference P22/S4643/O, dated 21 December 2022, was refused by notice dated 18 April 2023.

The application for an award of costs is allowed in the terms set out below.

The application for costs was made concurrently with another application for costs relating to a s106B appeal (ref 3320249) for broadly the same site. That application is the subject of a separate costs decision. My consideration here relates to the s78 appeal, as detailed in the above header.

The appeal is allowed and planning permission is granted for 64 dwellings consisting of bungalows, houses, detached garages, access roads, drives including landscape works at land to the west of 30 and 31 Torbay Drive, North East Lincolnshire, Grimsby DN33 3DQ in accordance with the application, Ref DM/0285/22/FUL dated 27 March 2022 subject to the conditions.
